			<content:encoded><![CDATA[<p>A Melbourne woman was arrested for driving the wrong way at an elementary school while intoxicated. The report was first offered by the Orlando Sentinel.</p>
<p>Charges were brought against Heather Brodeur, 33, who was driving to Suntree Elementary School. She entered the school parking lot from the exit side of the school, hit a gate and drove over a curb before finally leaving through the entrance for the student pickup. This is according the report which was given by the Florida Highway Patrol.</p>
<p>The arrest list which was filed at 3:55pm was for two counts of misdemeanor DUI with property damage, one misdemeanor count of DUI and a ticket for reckless driving. An additional charge was also brought against Brodeur  for driving on the wrong side of the road. After being processed on these charges, she was released from the Brevard County Jail on Thursday with a $2,000 bond.</p>
<p>Reports indicate that Brodeur has been in trouble with the law before. She has also been known to drive the wrong way more than once in her history.</p>
<p>In July 2010, Brodeur was arrested for an accident with property damage, two counts of DUI vehicle property damage or personal injury, and felony possession of methadone and buprenorphine. This past criminal history will be taken into consideration along with the current charges when figuring out what the sentence will be for Brodeur. The fact that she has repeated behaviors will not play into her favor when sentencing occurs. Even with misdemeanor charges, she is facing possible driving restrictions and the loss of her license. It is clear that the Florida mom needs to be more careful in the future when driving her car and stay away from drinking alcohol if she is going to be driving.</p>

			<content:encoded><![CDATA[<p>On Sunday, police in <strong>Kissimmee</strong> responded to an individual discharging a firearm in front of them. The officers just happened to witness <strong>Angel Santiago Jr., 25</strong>, discharge a firearm in their presence. They are not sure if Santiago knew of their presence at the time that they witnessed him. They are also unclear as to whether this was the first shot which was fired by Santiago.</p>
<p>Upon further inspection, it appeared that Santiago was intoxicated while he was operating the vehicle as well. His <em><strong>blood alcohol was tested</strong></em> and he was found to be outside of the legal range for the state of Florida. He was later arrested and charged with a list of different charges including DUI and gun charges. It is still unclear as to this time as to what the intention of Santiago was when he was firing his pistol.</p>
<p>The <strong>charges of DUI</strong> and discharging a firearm in public are both very serious safety violations and will be taken very seriously whenever he is brought before the judge. His willingness to put other people at risk is a factor which will play heavily in the sentencing portion of his arrest because the judge will not lightly offer a sentence in his case.</p>
<p>The list of charges is driving under the influence, discharging a firearm in public, using a firearm while under the influence of alcohol, possession of a firearm while being the subject of a domestic-violence injunction and carrying a concealed firearm. While some of these charges are likely to be dropped whenever the case goes to trial, it is obvious that the officers charging Santiago wanted to make sure to highlight just how serious the situation was and how imperative it is that he is punished severely for his actions.</p>

			<content:encoded><![CDATA[<p>Recent reports coming from the Florida Highway Patrol have implicated that they are being reprimanded for not making DUI arrests. The result of not having made DUI arrests means that the officers will have to work overnight shifts until they are able to get an arrest of a DUI driver.</p>
<p>The concern of many citizens is that there will be officers trying to meet quotas and pulling over people without just cause. Florida Highway Patrol Captain Tim Culhane advised reporters that the reason for the action is to make the streets safer. This only affects those who did not make a single DUI arrest in all of 2011.</p>
<p>Safety is said to be at extreme risk if the officers are not doing their job. The effort is being made to make sure that the officers will not anything slide. This way, they will be encouraged to pull over those who are even suspected of driving drunk. The result will be to make sure that those who are pulled over will understand how serious that the state is taking drunk driving. The more that people are aware of the risk they are taking, the more likely it is that they will think twice before driving drunk.</p>
<p>The effort being made is not to encourage police officers to do anything which is beyond their responsibilities. It is only to make sure that they are taking DUIs as serious as possible and maintaining the safety of those who are driving the streets every day. More DUI arrests means less drivers on the streets driving under the influence.</p>
<p>While some prosecutors worry about how this will lead to some cases being overturned, it does not appear that the decision is going to be changed any time soon.</p>

			<content:encoded><![CDATA[<p>On Tuesday, Andrew Emmons was sentenced in his part of a DUI that took place February, 10 2010. The courtroom was filled with emotional supporters from both sides of the court. There was even support of Emmons from the family of the victims.</p>
<p>When Emmons crashed into the van that the couple was riding in on I-95, the two were killed in the accident. Rodney and Louise Copeland were taken from their family because of the fact that Emmons was driving with a blood alcohol level which was three times the legal limit for a driver in Florida.</p>
<p>The family was allowed to speak to Emmons before sentencing took place. They were allowed to let Emmons know what he did with driving drunk. They were also able to read the names of the victims and show the pictures of them before he was sentenced.</p>
<p>One of the sisters of the victim even let Emmons know that they will suffer for the rest of their lives from the loss while he will only suffer while in prison. Another sister also made sure to offer a prayer to Emmons to stay safe while he was going through his ordeal.</p>
<p>Emmons offered a tear-filled apology to the family of the Copelands for his part in the accident. He seemed to be truly moved by the loss that the family was feeling.</p>
<p>Emmons was sentenced to 15 years in prison which was scaled down from 30 years as a result of a plea agreement which the family of the victims agreed to. They felt that the relief of having a guilty plea without having to go through the pain of a trial was worth allowing him to get out sooner. His sentence began immediately.</p>

			<content:encoded><![CDATA[<p>At around 1 a.m. Deputy Sheriffs were in the proximity of the train tracks when they noticed a car down a dirt path. The car slowly backed up and ended up getting stuck on the train tracks. At the same time, the officers noticed that there was a train approaching the location of the car.</p>
<p>Moving quickly, the two officers, Deputy Roy Johnson and Sgt. Joe VenWeelden approached the car which was lodged on the tracks. They encouraged the driver and passenger, Simon Kubitza, 34, and Paula Poissant, 39, respectively, to exit the vehicle. When they did not get out fast enough, the officers removed them from the vehicle.</p>
<p>Sgt. VanWeelden entered the gray Nissan in an attempt to remove it from the tracks before the train arrived. The car was clear from the tracks as the train roared past. No one was harmed in the incident, but it was a very close call for all parties involved.</p>
<p>The couple was apparently so intoxicated that they were not even aware that they were in any danger. They realized that they were stuck on something, but did not understand that they were almost killed by a passing train. Kubitza was arrested after failing a field sobriety test and <a href="http://www.duiorlando.org">charged with DUI</a>. He was taken to Marion County Jail to await bond hearings.</p>
<p>The two officers were in a construction site close to the tracks whenever they heard the train and noticed the car. They were located near U.S. Highway 326 and NE 36<sup>th</sup> Avenue. It was fortunate that they were in the right place at the right time or the night could have had a much worse outcome than just someone being taken to jail for a DUI. Someone could have died in similar circumstances.</p>

			<content:encoded><![CDATA[<p>There are many problems that drivers face whenever driving drunk. For many getting arrested for a <a title="dui charge" href="http://www.duiorlando.org">DUI charge</a> is the least of their worries. More at stake is their life and the lives of those who are also on the road at the time. A good example of this was played out on State Road 408 when 22-year-old Casselberry resident Shaylyn Gabrielle Brady was driving in the wrong direction.</p>
<p>Brady caused an accident at 12:45 a.m.  when she collided with an ongoing car sending the other car to flip over the guard rail and onto its side. The driver of the other vehicle was fortunate to have only minor hand injuries, but the damage to their car was extensive.</p>
<p>When questioned about where she was coming from, Brady indicated that she had just left Senor Frog’s. Leaving from the new establishment on International Drive, Brady entered into the opposite lane of traffic and caused the accident.</p>
<p>The officer on the scene, Kristine Rosado, could smell the “overwhelming” odor of alcohol whenever she approached Brady. The report states that Brady had bloodshot eyes and slurred speech. When asked to exit her vehicle, Brady become combative and refused twice to get out of the vehicle.</p>
<p>When the Field Sobriety Test was conducted, Brady was unable to pass the “walk and turn” test or the “stand on one leg” test. With these two tests being failed, Brady was taken into custody and transported to the nearby DUI testing center.</p>
<p>The tests conducted at the DUI testing center indicated that Brady had a .212 blood-alcohol level. With the legal limit being at .08, Brady was well over the minimum to be charged with DUI. Additional charges included property damage and personal injury. She was processed at Orange County Jail before bonding out.</p>

Because he is free on a $10,000 bond, it was up to the judge as to whether he would be able to travel or not. He was denied pending the results of his next court date which is in March. Even with good lawyers on his side, it was not enough for Careega to get permission to travel to Mexico City on his business trip.</li>

It is something which Broward Circuit Judge Lisa Porter will keep in mind whenever requests like this come along from Careega.</li>

<p>DUI related deaths are something which are fairly common in a part of the country where people come to have fun. While DUI deaths can be reduced by making sure to not drive after drinking, it is not likely that they will reduce too easily in the near future. Careega will likely have to spend the rest of his time awaiting the trial without getting a travel allowance because of the severity of the case which he is related to.</p>

In a recent study where Men’s Health published the results, it seems that the warmer cities have an average DUI rate higher than other cities. Or is it how you interpret the data? Because there is always wiggle room when the data is presented without looking too far behind it.</p>

<li><strong>Orlando was ranked right in the middle</strong> of the poll and considered to be one of America’s drunkest cities. That’s not something to be proud of. But what makes it rank high on scores of binge drinking and arrests? It could have something to do with the underage drinking and the college campus that sits on the city limits.</li>

<li>How many cities with a large college in their midst scored high on the drunk cities list? Quite a few. And sadly, what are college campuses known for these days? Parties and a lot of drinking. So it is no surprise that in these cities there are more arrest for drunkenness because there are a lot more people out and about, after football games, before and after fraternity and sorority parties and on the weekends who drink to excess.</li>

<li>How do you conduct a poll like that and factor out the college info? You can’t really. Because there are all kinds of people associated with the college that might not be a student in the traditional sense. There could be undergraduate assistants, people going to school that aren’t traditionally aged and there could be people in town visiting the true college students that get arrested. There could even be visiting family members who get arrested on a DUI if they are in town visiting and decide to go out on a Saturday night and party a little too much.</li>

<h2>Is Orlando a Party City?</h2>
<ul>
<li>It’s unfortunate, but it seems that Orlando might get labeled as a drunk and party city, even when a college campus might skewer the results. But it doesn’t change the fact that there are an excess number of DUI arrests in the area. How does that affect the entire city?</li>

<li>It makes the demand for police remain high. People need to monitor the streets and keep it safe for the other people on the road. Keeping police officers around the clock is not cheap. There is also more administrative costs in the courts and at the jails to process the people who are arrested and booked on charges of DUI. These people all have incomes to pay out of tax money the city collects. The more taxes it takes to pay all of these salaries, the more everyone around pays to keep it up.</li>

<p>Another thing that having a high DUI rate does is increase the insurance premium rates for everyone involved. If there are more DUIs, then there is a chance for more accidents in the area, involving people who aren’t drinking too. The DUI arrests involve everybody’s insurance rates after a while, not just those who get in to accidents.</p>
