What Can Happen with a DUI Refusal

When you are suspected of driving under the influence in Florida, there are several things the reporting police officers need to do. One thing includes observation and then testing of you or the suspected person. The tests that may be asked of you to perform include a breathalyzer test, blood test and maybe even a urine test. Do you have the right to a dui refusal? What happens when you refuse to perform one or any of the tests after you have been pulled over but before you are arrested? There are certain rights you have as a suspect, but there are also certain penalties you can face when or if you refuse one or more types of testing.

For some reason, if you refuse the test, you can face as many penalties as if you were to take and fail the test. Dui refusal for  a breathalyzer test can earn you a license suspension and fines for refusal of the test.

• Even though the results of a breathalyzer test can be altered because the machine was not calibrated properly and you could get off of the charges, you have to take the test first. Refusing the breathalyzer test can mean you get a suspended license right away, you have to pay fees associated with refusing the test and then you will still have to face court and fees associated with suspicion of operating your vehicle while being under the influence of something.

DUI Refusal and Other Tests

• There are other types of tests that you can request to take if police suspect you have been operating a vehicle while you are driving under the influence.  If you are under the influence of drugs, it will not be detected by a breathalyzer test. The tests that would pick up drug use could include a blood or urine test or even both. In order to take either of these tests, you would need to be transported to a hospital or a lab and take the tests while police wait. Most likely you will be placed in jail until the results of these tests come back. Transportation to and from the hospital or the lab will be provided by the police.

• When you refuse to take a blood or an alcohol test, you will still be kept in a jail.  The courts will look back at your record and determine how long you will be kept in jail and if you will be released on bond, pending the charges and test results you do end up taking while in their care. A DUI refusal is something that should be taken very seriously.
